Strategic Finance Ltd chief executive Kerry Finnigan said Allco Strategic was placed in liquidation as it was no longer required following the appointment of receivers to Allco HIT on 7 November. Mr Christian said Strategic Finance didn’t believe the liquidation would have any immediate impact on it.

Other details: Canterbury Homes’ liquidators said Ms Faid had attributed the company’s collapse to tight credit. They’ve also told unsecured creditors owed $2.5 million they’re unlikely to get anything back. Although the statement of assets & liabilities is incomplete, one thing that has been included among the assets is goodwill – book value $940,532, no estimate of how much it might realise. The company has 2 show homes at different stages of construction, also with unknown realisation values, and owes the Bank of NZ $306,000. Pegasus Property Ashburton owes unsecured creditors about $460,000. Pegasus Property Christchurch has just over $3 million of land & buildings (current value not estimated), BNZ debt of $3.3 million, unsecured creditors owed $835,000. Pegasus Property Palmerston North owes unsecured creditors $48,000, other debts & assets not quantified yet. Pathway to Wealth changed its name to XPTW on 16 May, after liquidation. After director Matthew Faid died in November2007 the company was unable to meet its commitments to buyers of his wealth promotion packages. The intellectual property was sold in March for $10,000. The immediate owner of all the liquidated companies is Pegasus Property Management Ltd. Ms Faid is also a director of James Line Property Ltd, St Martins Investments Ltd & several other companies. The demise of the Faid group has been evident for a year, but when Pegasus Town developer Bob Robertson (Infinity Investment Group Ltd) issued a release today following the 9 December liquidations, his concern was to distance the Faid companies from the developer. In doing so, he managed to name the Faid parent company incorrectly: “The situation is made more difficult by the fact that the parent company of Canterbury Homes Ltd, Pegasus Properties, has a similar name to the development company – Pegasus Town Ltd. The holding company for Canterbury Homes Ltd is in no way related to Pegasus Town Ltd,” he said. The Faid parent company is Pegasus Property Management Ltd. Mr Robertson brushed the Faid companies’ demise aside, saying the liquidation of Canterbury Homes “potentially affects 48 of the 779 sections already sold at Pegasus. However, many of Canterbury Homes’ sections have been pre-sold to residential purchasers along with a contract to build a house. Pegasus Town Ltd understands these build-out contracts are now being handled by one of the other house-building companies at Pegasus. The balance of the sections will go back to Pegasus Town Ltd, who will also receive the benefit of a bank guarantee bond from Canterbury Homes Ltd.”

Other details: The 4 plaintiffs’ applications went to a hearing on 4 December before Associate Judge John Faire, who delivered his decision on 10 December. At the start of the hearing, the application of first plaintiff South Waikato Precision Engineering was struck out. The second & third plaintiffs claimed licence agreements for the sale of Ahu’s product, the U-Parkit stacked parking system, in New South Wales (second plaintiff) and the UK & Europe (third plaintiff). In both cases the judge said there were disputes which were properly dealt with in normal litigation, not on the companies liquidation list. The fourth plaintiff’s claim was for commission for sale of a system to MacRennie Commercial Construction Ltd for use in the Ironbank building being developed by Samson Corp Ltd at 150-154 Karangahape Rd through to Cross St. However, Associate Judge Faire said that contract appeared to have been cancelled. None of the plaintiffs arrived in court with a statutory demand to enforce, relying instead on just & equitable grounds to proceed to liquidation. But Peter Jefferies, both an Ahu director & the company’s lawyer, produced a balance sheet showing an excess of assets over liabilities, although he acknowledged in court the company might have difficulty paying some debts as they fell due. The judge saw no reason to appoint a liquidator and refused all applications.
